These Terms of Service (“Terms”) govern your use of durracell.com (the “Site”) and the products, content, and services offered by Durracell, LLC (“Durracell,” “we,” “us,” or “our”). By using the Site, contacting us, purchasing from our shop, or booking a performance, you agree to these Terms. If you do not agree, please do not use the Site.

02What we do

Durracell is a Michigan-based music artist and brand offering live and studio music, performances for venues and events, original recordings, and merchandise sold through the Site. Specific performance bookings, deliverables, pricing, and dates are defined in a separate written agreement with each client or venue. In the event of a conflict between these Terms and a signed booking agreement, the booking agreement controls.

04Purchases, donations & refunds

Prices for merchandise and other products are listed on the Site and are subject to change. Payments are processed by third-party payment providers. Donations made through the Site are voluntary and non-refundable. Refunds or exchanges for merchandise are handled on a case-by-case basis; please contact us using the information below if there is a problem with your order.

05House rules

You agree not to use the Site for any unlawful purpose, to interfere with its operation, to attempt to gain unauthorized access to any part of the Site, or to submit false or misleading information through our forms or chat widget.

06The music is ours

All content on the Site, including music, recordings, lyrics, artwork, videos, text, graphics, logos, and design, is owned by Durracell, LLC or its licensors and is protected by applicable intellectual property laws. Logos of partners, venues, and media outlets shown on the Site are the property of their respective owners. You may not reproduce, distribute, or publicly perform Site content without our prior written consent.

07Third-party links & tools

The Site may include links to third-party websites and embedded tools such as streaming players, ticketing, payment processing, and chat. We are not responsible for the content or practices of third-party services, and your use of them is subject to their own terms and policies.

08Disclaimer & limitation of liability

The Site is provided “as is” without warranties of any kind. To the fullest extent permitted by law, Durracell, LLC will not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or attendance at any event.

These Terms are governed by the laws of the State of Michigan, without regard to its conflict of law principles.
